Qualmark Corporation and Data Physics Corporation Litigation Settlement Announcement

Qualmark Corporation, a Colorado corporation and Data Physics, a California corporation, today jointly announced the settlement of litigation between the companies, where Qualmark alleged infringement of its Ling trademarks by Data Physics and Data Physics alleged interference in certain of its contracts, including its contracts with the Government, by Qualmark. As part of the settlement Qualmark has sold its Ling and ACG Electrodynamic Shaker Business assets to Data Physics and Data Physics has agreed to perform Warranty Services and Support to Qualmark so that Qualmark can fulfill its warranty and support obligations to its customers. Qualmark also signed an agreement not to compete in the Electrodynamic Shaker business with Data Physics for one year.
